New York

New York requires dental hygienists to practice under a licensed dentist's supervision at all times; most preventive/diagnostic services (scaling and root planing, sealants, fluoride, radiographs) may be performed under general supervision, where the dentist authorizes the service in advance and need not be physically present. Administering local anesthesia or nitrous oxide requires a separate restricted certificate and New York's stricter 'personal supervision' standard, under which the dentist must remain in the dental office. New York does not permit direct access or fully unsupervised hygiene practice; the only supervision-free option is a narrow hospital-employee collaborative arrangement, itself capped at general-supervision-level services.

Verify before relying on this: scope-of-practice regulations change frequently. This entry was last checked against primary sources on 2026-08-30. Confirm current requirements with the New York dental board before making decisions based on it.

Permitted functions & supervision required

  • Scaling and root planing

    General supervision

8 NYCRR 61.9(b)(1): scaling and planing of exposed root surfaces is a general-supervision service.

  • Local anesthesia administration

    Indirect supervision

Requires a separate Restricted Local Infiltration Anesthesia/Nitrous Oxide Analgesia Certificate. New York's 'personal supervision' standard (8 NYCRR 61.17(a)(2)) requires the dentist to remain in the office (not necessarily the treatment room) and personally examine the patient before dismissal, the closest match to 'indirect' as defined here.

  • Nitrous oxide monitoring/administration

    Indirect supervision

Same restricted certificate and personal-supervision requirement as local anesthesia (8 NYCRR 61.17).

  • Application of sealants

    General supervision

8 NYCRR 61.9(b)(10): applying pit and fissure sealants is a general-supervision service.

  • Application of fluoride varnish

    General supervision

    8 NYCRR 61.9(b)(6): topical anticariogenic/fluoride applications are a general-supervision service.

  • Taking radiographs (x-rays)

    General supervision

8 NYCRR 61.9(b)(5): taking and exposing dental radiographs is a general-supervision service.

  • Hospital collaborative arrangement (general-supervision-level services)

    Collaborative practice

NY Education Law §6606 permits a hospital-employed RDH to work under a written collaborative arrangement with a dentist formally affiliated with that hospital, without the dentist's physical presence, but only for services otherwise permitted under general supervision (no local anesthesia/nitrous oxide). Not available in private practice, and not true direct access.
